动词隐含因果性和语篇话题性对回指选择的影响

动词隐含因果性和语篇话题性是制约回指选择的重要因素,但两者对回指选择的影响机制及交互作用仍不明确。语篇生成续写实验表明,动词隐含因果性确实会影响到后续指称对象的选择,并在原因类联结关系中得到加强;当动词语义倾向回指的对象为新引入的实体,而非语篇话题时,其回指倾向最显著。这说明基于给定语境生成语篇的过程遵循省力原则,但与语篇话题性相比,动词隐含因果性对回指倾向的制约更具刚性。     

价差期权的合约设计、定价与实证分析——基于冶炼价差期权的应用

研究价差期权的合约设计及其定价方法,对于提高我国各类经济实体的风险管理水平以及我国衍生品市场的未来发展具有重要意义.依据我国螺纹钢与铁矿石等冶炼价差的统计特征,借鉴国外价差期权定价方法,对冶炼价差期权的实际价值、理论价格进行了测算,结果表明:在冶炼价差期权中,螺纹钢与铁矿石的价差、钢坯与铁矿石的价差的绝对变化幅度更大,对应的价差期权的实际价值更大,对应的套保需求会更大;与铁矿石有关的价差(螺纹钢与铁矿石、钢坯与铁矿石)期权的套保效果更好.建议先行推出螺纹钢与铁矿石、钢坯与铁矿石这两种冶炼价差期权.     

学术写作的互动式话语策略

学术写作并非完全机械化,也并非全盘避免作者主观情感的介入。学术作者使用多种话语策略来宣传其观点和立场,营造和谐对话空间,与读者形成良好互动,从而引导读者接受所述命题观点。基于学术语篇互动模型,分别从模糊语策略、作者身份构建方式以及作者与读者的隐性互动三个方面来阐释学术写作中的互动式话语策略。研究表明,每个学科都有其偏好的写作模式,教师应引导学生关注所属学科的语言范式,培养学生的读者意识,并在学术写作中采用积极有效、易于被读者接受的互动策略有力发声,推进研究。     

股权众筹是否真的那么美--基于美国制度缺陷的再思考

股权众筹作为初创企业采用的一种利用互联网向大众募集小额资本的融资方式，以“脱媒式”对接投融资双方的优势，利用互联网的人群聚集与信息广泛传播效应，降低投融资方之间沟通成本，有助于投融资意向的快速达成。2012年美国JOBS法案的高调出台，吸引了全球范围内的广泛关注。但股权众筹制度在美国已受到诸多批判，除信息披露要求弱化引发的欺诈风险增加外，在注重前端融资效率的同时却忽略了投资端的设计和保护，尤其是众筹股权的流通和退出问题等。美国立法与实践领域对于这些问题尚未取得彻底的突破。股权众筹以美国模式为样板引入中国，在遭遇中国固有法律体系及制度的困扰后，中国股权众筹实践陷入更多困境。通过对美国相关制度出台的背景及存在的不足进行分析，对照中国实践，锁定实践中产生的新问题，并深入探讨现有解决路径能否真正缓解这些不足，以期对股权众筹制度重新进行明确的定位。     

The labour market flexibility debate in India: Re‐examining the case for signing voluntary contracts

A major focus of India's ongoing policy debate over labour market flexibilization has been the statutory requirement that firms employing 100 or more workers cannot dismiss employees without prior government permission. The case for repealing that requirement (or greatly increasing the workforce threshold) is notably underpinned by Basu, Fields and Debgupta (2009). Here, the author challenges their particular theoretical argument for hiring and firing at will based on the voluntary signing of contracts, demonstrating that their general policy conclusion is logically unsustainable even within the framework of that model. The case for labour market flexibilization through voluntary contracting thus remains unfounded.     

长期股权投资准则修订变化及对企业财务的影响研究

2014年7月1日,新修订的企业会计准则率先在所有执行企业会计准则的企业范围内施行,这意味着企业的财务核算、财务报表等面临新的问题和挑战.长期股权投资是企业会计核算中的重点和难点,其会计核算方法比较复杂,不同的会计核算会对企业的财务产生不同的影响.本次长期股权投资的修订,规范了长期股权投资的会计核算方法,使其持续趋同于国际会计准则,有利于我国对外经济合作,有利于适应社会经济的发展.本文主要剖析了长期股权投资准则修订前后的变化,对其主要会计核算进行举例分析,并分析其对企业财务的影响.     

The Structure of Legal Relations in Online Transactions*

As the civil law expression of internet plus transactions, the legal relations in online trading platform transactions constitute a complex aggregate of legal relationships composed of groups of legal relations. Specifically, they consist of three basic interlinked legal relationships: Contract relations for online trading platform services between the platform provider and the seller or service provider, and between the platform provider and the consumer. This includes the sales or service contract relations between the triad of the seller, the service provider and the consumer. These relations contain five kinds of major content, viz., the provision of transaction space, the publishing of transaction information, price escrow payment, distribution and delivery of the commodity, and transaction credit evaluation. They involve three forms of supplementary legal relations: the supplementary contract relationship between the platform provider and a third party payment institution; between the seller and third party credit reporting agency; and between the seller and a logistics enterprise. The three forms of supplementary contractual legal relations are set up to act on the major contents of the basic legal relationships in online transactions. On the basis of the online trading platform service contract relationships between the platform provider and the triad of the seller, the service provider and the consumer, the flow of the above- mentioned legal relations centers on the contract of sales or service set up between the seller, the service provider and the consumer to accomplish the aim of the online transaction, meet social needs and boost economic development.     

What influences the size of child maintenance payments? A register‐based study of maintenance payments in Finland

The aim of this study was to explore how particular economic and demographic factors contribute to the level of the child maintenance payment (CMP) paid by the non‐resident parent. For this study, we used 5‐year longitudinal panel data from years 2009 to 2013 consisting of over 80,000 non‐resident parents from the Finnish Tax Administration and The Finnish Population Register Centre. Results from regression models indicate that the single biggest factor affecting the size of CMPs is the number of dependent children. We found that the non‐resident parent's higher income is associated with higher CMPs and that non‐resident fathers pay on average larger CMPs than non‐resident mothers, even after accounting for differences in income. Unexpectedly, we found that the age of the dependent child did not predict changes in CMPs. This suggests that once formal CMP‐contracts are determined between the parents, they are seldom changed. Our results suggest that some degree of mandatory periodic review for maintenance contracts is worth considering.     

Differences in Experiences of Discrimination in Accessing Social Services Among Transgender/Gender Nonconforming Individuals by (Dis)Ability

Transgender and gender nonconforming (GNC) individuals frequently experience discrimination and potentially a lack of respect from service providers, suggesting they have decreased access to professionals with cultural competency. Similarly, people with disabilities experience higher levels of discrimination in social services than their nondisabled counterparts. From an intersectional perspective, this study examines rates of discrimination in accessing social services faced by transgender and GNC people, comparing across ability. Data indicate that although transgender and GNC individuals of all abilities experience gender-based discrimination when accessing social services, those with disabilities experience higher levels of antitransgender discrimination in mental health centers, rape crisis centers, and domestic violence shelters.     

铁路总价承包合同管理存在的主要问题及对策

结合我国铁路总价承包合同执行现状，对铁路合同专用条款中存在的承发包双方法律地位不对等、工程款拨付比例不切实际、总承包风险费严重不足等主要不合理内容进行剖析，说明不合理的原因。对发包人处理正负量差的方式、工期调整产生的赶工费不能全额解决及部分变更设计在源头上得不到认可等在合同执行过程中存在的问题进行研究。简单分析产生不合理条款和合同执行不到位的主要原因。针对这些不合理条款，提出应对策略。
