法院对重整计划的强制批准是破产法中的核心法律制度,“供给侧结构性改革”推动了法院对重整计划强制批准的司法适用。中国法院对这一“舶来”法律制度的司法适用存在诸多问题:严重的社会本位主义、盲目过高的适用比例、与正常批准的关系颠倒、缺乏全面的审查规定、对普通债权人的保护不利等。要回归法院强制批准正确的司法功能,确保中国法院对重整计划强制批准的正当适用,就必须借鉴《联合国破产法立法指南》及域外的立法,结合2018年最高院《破产审判会议纪要》“审慎适用”规定,从理论、立法和司法层面寻求对问题的解决途径包括充分认识法院强制批准权力的属性、正确定位正常批准和强制批准的关系、修订完善强制批准的实体审查条件、合理构建强制批准的审查程序等。法院对重整计划强制批准问题的解决有助于中国《企业破产法》的修订完善。 相似文献

In this article, a variable two-stage acceptance sampling plan is developed when the quality characteristic is evaluated through a process loss function. The plan parameters of the proposed plan are determined by using the two-point approach and tabulated according to various quality levels. Two cases are discussed when the process mean lies at the target value and when it does not, respectively. Extensive tables are provided for both cases and the results are explained with examples. F)α i , where α i is a known positive constant and F is an absolutely continuous cdf. Also, suppose that we have observed the maximum and minimum of the first k samples. This article shows how one can construct the nonparametric prediction intervals for the order statistics of the future samples on the basis of these information. Three schemes are studied and in each case exact expressions for the prediction coefficients of prediction intervals are derived. Numerical computations are given for illustrating the results. Economic selection of process parameters has been an important topic in modern statistical process control. The optimum process parameters setting have a major effect on the expected profit/cost per item. There are some concerns on the problem of setting process parameters. Boucher and Jafari (1991) first considered the attribute single sampling plan applied in the selection of process target. Pulak and Al-Sultan (1996) extended Boucher and Jafari's model and presented the rectifying inspection plan for determining the optimum process mean. In this article, we further propose a modified Pulak and Al-Sultan model for determining the optimum process mean and standard deviation under the rectifying inspection plan with the average outgoing quality limit (AOQL) protection. Taguchi's (1986) symmetric quadratic quality loss function is adopted for evaluating the product quality. By solving the modified model, we can obtain the optimum process parameters with the maximum expected profit per item and the specified quality level can be reached. 相似文献

The foldover is a useful technique in the construction of two-level factorial designs for follow-up experiments. To search an optimal foldover plans is an important issue. In this paper, for a set of asymmetric fractional factorials such as the original designs, a lower bound for centred L 2-discrepancy of combined designs under a general foldover plan is obtained, which can be used as a benchmark for searching optimal foldover plans. All of our results are the extended ones of Ou et al. [Lower bounds of various discrepancies on combined designs, Metrika 74 (2011), pp. 109–119] for symmetric designs to asymmetric designs. Acceptance sampling is a quality assurance tool, which provides a rule for the producer and the consumer to make acceptance or rejection decision about a lot. This paper attempts to develop a more efficient sampling plan, variables repetitive group sampling plan, based on the total loss to the producer and consumer. To design this model, two constraints are considered to satisfy the opposing priorities and requirements of the producer and the consumer by using Acceptable quality level (AQL) and Limiting quality level (LQL) points on operating characteristic (OC) curve. The objective function of this model is constructed based on the total expected loss. In order to illustrate the application of the proposed model, an example is presented. In addition, the effects of process parameters on the optimal solution and the total expected loss are studied by performing a sensitivity analysis. Finally, the efficiency of the proposed model is compared with the variables single sampling plan, the variables double sampling plan and the repetitive group sampling plan of Balamurali and Jun (2006) in terms of average sample number, total expected loss and its difference with ideal OC curve. 相似文献
