人权保障的关键路径探析:以韩国为例

在韩国人权保障事业的演进过程中起到重要影响的因素有国际人权组织、民主化、政府、第三部门。其中,前两者是外因和条件,而后两者是主要的推动力量。由于韩国"行政上位的行政与政治一体化"体制,韩国政党强烈地受总统的影响,具有很强的从属于行政的性质。因此,韩国人权事业的浮沉同样受政府政策的影响强烈。但在人权保障事业上政府也有局限性,而这一局限性是由第三部门来弥补的。

The Key Path of Human Rights Protection:A Case Study of South Korea

The important factors in the evolution of human rights protection in Korea include international hu -man rights organization , democratization , the government and the third sector .Among them , the former two are ex-ternal causes and conditions , while the latter two are the major driving force .With the system of “administrative-led integration of administration and politics” in South Korea , the political parties are strongly influenced by the president and subordinate to the administrative government .Therefore , the cause of human rights in South Korea is strongly influenced by the policies of the government .The government has some limitations in safeguard of human rights, which have been made up by the third sector .
