腐败犯罪跨国跨境追赃问题研究

对腐败分子而言,国内已不再是安全的港湾。为了规避调查,腐败分子往往将非法所得财物转移至国（境）外。无论从程序还是从实体的角度看,跨国跨境追缴赃款赃物都具有重要意义。我国当前腐败犯罪跨国跨境追赃主要是通过劝退、民事诉讼和国际刑事司法合作等方式,但仍面临许多困难和问题。建议借鉴运用国际法律规定,特别是在《联合国反腐败公约》框架下,积极开展国际范围的司法合作,进一步完善我国腐败犯罪跨国跨境追赃机制。

Study on the Issues of Cross-boundary Booty-Recovery in the Circumstances of Corruption

In terms of corruptionists,China is no longer a safe haven.In order to avoid investigation,corruptionists often transfer illegally acquired property to the country（territory） outside.Whether from the program or from the perspective of the entity,cross-boundary booty-recovery is of great significance.Currently,this problem is solved primarily by discouraging,civil and international criminal justice cooperation,etc in our country.But we still faces many difficulties and problems.The proposal draws upon the application of international law,especially in The United Nations Convention Against Corruption framework.Through actively moving around in international judicial cooperation,we should further improve cross-boundary booty-recovery mechanism in the circumstances of corruption.
