法律关系向来是我国法理学中的重要理论课题,高校学报所涉及的期刊行政管理关系和学报与各横向主体之间的权利义务根据相关法律规范的调整,就结成了以高校学报为一方主体的多重法律关系。理顺这些法律关系对维护我国期刊出版的正常秩序及保护各方的正当合法权益都是十分有益的。然而我们至今未见有关于高校学报著作权法律关系的系统论述,这个课题乃是一个空白。按照法学理论上不同的分类标准对这一法律关系可以进行学理上的分类解析;而按照这一著作权法律关系的主体、内容的相对稳定性特征,可以描述出五种具体的高校学报著作权法律关系。这对观察和构建我国整个期刊乃至整个出版物的法律关系都是十分有意义的。  相似文献

《公民权益和政治权利国际公约》对出版自由以国际公约的形式对各缔国加以约束,不同社会制度、不同文化传统、不同发展阶段的国家的宪法或其他法律,对出版自由一般都有明文的规定。研究世界各国法律、法规对于出版自由的规定,可以对我国出版自由立法形成有益的借鉴,同时紧跟国际形势,推进我国的出版贸易。  相似文献

所谓"幸福发展观",就是以人类幸福、每个人的全面而自由的发展为终极目标的"科学发展观"在人生观和价值观上的体现,它凸显了"科学发展观"的主体向度,是"思想道德修养与法律基础"课程教学目标的一种崭新概括。我们认为,通过专题教学法,把德育与法制教育结合起来,将教学内容融为一个道德化的法制教育和法制化的德育的有机整体,构成一个"幸福发展观"的教学体系,可以有效克服目前"基础"课普遍存在的"拼盘式"教学现象和"千人一面"的说教形象,提高"基础"课的吸引力、亲和力、影响力。  相似文献

婚姻是一种对性的管理制度.性权利是婚姻权利的上位概念,婚姻自由是性自由在婚姻制度下的要求与状态.长期以来,性自由的"污名效应"使权利的诉求不得伸展,同时也导致了对婚姻自由的片面理解.性自由权理论包含了积极自由与消极自由的统一,而婚姻自由中二者的对立成为性自由权与婚姻自由的主要冲突."婚姻自由"通常仅在消极自由的意义上被使用,与之相应的"婚姻不自由"揭示出积极自由缺位时消极自由所处的尴尬境地.积极自由与消极自由的融合是后现代法学发展的趋势,性自由权与婚姻自由的调和主要通过降低婚姻的进退成本和增加婚姻的输送机制与替代机制两条途径来完成.出于对中国国情的考虑,放宽离婚的条件与立法规制非婚同居具有尤为重要的现实意义.  相似文献

从西汉"引礼入法"到清末"礼法之争",两千多年来,儒家法律思想一脉相承地在我国法律思想史上占据着极为重要的位置。虽然现代法治思想与儒家法律思想呈现出较大的冲突,但时代的发展也表明,儒家思想的博大精深及合理成分使它具有无限生命力,并能够在相当程度上与现代社会发展的深层需求相融合。反思儒家法律思想与现代法治思想的深层融合点,挖掘传统法律文化鲜活的现实作用,对我国当代法治建设及社会主义和谐社会建设大有裨益。  相似文献

人类离不开"劳绩",也离不开"诗意"。诗意栖居是人类理想的生存方式。当下的中国和世界都正在加速发展,我们都在"被加速",繁忙是常态,精神被抽空,在一个全民大谈经济和科学的今天,我们过于"求真",过分"劳绩",缺少的就是"诗意",然而对诗意栖居的理想渴望却凸显强烈与迫切起来。诗意栖居的核心是求美向善的艺术精神,艺术精神的获得主要通过艺术习得。个体应该通过主动的艺术习得,提高个体艺术素养:社会应该营造崇尚艺术的氛围,提高社会整体艺术素养;教育应承担起培养素养的重任。让艺术精神的陶冶和对科学真理的追求伴随我们与世界的成长。  相似文献

李步云教授指出,宗教信仰自由问题是人权自由体系中的一个重要组成部分:法律与宗教问题是很有前途的课题,应该大力开展研究.第二届法律与宗教学术研究会取得丰硕成果:在法律与宗教研究的理论和方法、基督教对近代宪政的重要作用、圣经神学人格到宪法上的人格权的关系、中国传统文化中法律与宗教的关系、部门法中法律与宗教的关系,以及我国当前的宗教政策与法律等方面都做了深入的探讨.与会代表一致认为,如何进一步从法治层面保障公民的宗教自由,开放宗教市场,并与国际规则接轨,是我国在今后进一步改革开放中亟待解决的问题.  相似文献

Social work's role in creating social solidarity requires an engagement with identity politics through careful negotiation of the boundary between the private and the public spheres and hence ensuring a balance between personal freedom to define one's specific identity and the public entitlement to belong to a political community as citizens. Current political and cultural trends, reflected also in social policies, impact severely on that boundary maintenance task inasmuch as privatisation encroaches on formerly public domains while simultaneously details of private concerns receive public attention through their commercialisation by the new media. It is suggested that social work's political role be asserted more explicitly in terms of the application of the Global Agenda which needs to penetrate to the level of person‐to‐person interaction.  相似文献

本文讨论了当代中国城市本地人排斥进城农民这一问题的发生机制。通过剖析经典利益威胁假说,依托冲突理论以及中国的现实情境,本研究考察了市民与政府关系的演化及其对排斥进城农民的影响。通过对“2011年中国社会状况综合调查”数据的分析,本研究获得以下发现:(1)本地市民对进城农民的排斥部分源于其当前生活境遇的恶化,但更主要的原因是过去的利益受损经历以及对未来社会地位变化的悲观预期;(2)本地市民对政府供给公共服务的不满,会降低其对进城农民的接纳意愿;(3)在本地市民中,遭受利益损失的“失意者”对进城农民的排斥态度显著受到其对政府行政能力不满以及政府解决社会不平等问题低效的影响。本研究证实了市民对进城农民的排斥意愿中存在“替罪羊”机制。  相似文献

We examine in this article the impact of digitization on the provision of public services by studying how citizens experience the use of web portals in their pension planning. Based on focus groups and user test material, we elucidate five critical phases that each operate as an obstacle for citizens' further engagement in the digital self‐service process: interest, access, comprehension, reflection and support. We argue that these phases and the obstacles they entail illustrate a transition away from a situation in which control and agency over the quality of public services is embedded in a dyadic relationship between citizens and frontline personnel, and to a situation characterized by more complex relations between citizens, the front line, and the digital infrastructure. We argue that this transition implies that citizens are required to possess a new type of competence that contains both financial and digital skills. Citizens who are unable to develop or acquire such competence are likely to be disadvantaged by the services. Lastly, we argue that these developments pose significant challenges for public administrations to ensure the overall quality of the public services.  相似文献

How and when does welfare policy contribute to shape public opinion? This article departs from the policy feedback research tradition and seeks to contribute to the understanding of how policy influences public opinion (public responsiveness). The argument here suggests that personal experiences in terms of empowerment condition the dynamics between policy and opinion. The empirical case concerns the implementation of a consumer's choice model in Swedish primary health care, which resulted an intended increase in private health care centres. In this case, empowerment is assumed to be enhanced by increased exit options and freedom of choice. The specific question in the analysis is whether citizens who have empowering experiences, as a consequence of the reform, are more likely to be positive towards further privatization of welfare services. The results show few effects in general, but there seems to be a correlation between the experience of exiting and more positive attitudes towards privatization.  相似文献

In the past fifteen years, the Italian welfare state has gone through various important reforms. Almost all social policy fields have been significantly challenged by the presence of both national and European constraints, and in different policy fields some fundamental principles of the welfare state have been questioned and changed. The purpose of this article is to present an analysis of the most recent arguments used for welfare state reforms in Italy, focusing in particular on one key question: have the reforms been formulated and implemented in order to increase the freedom of choice of Italian citizens with respect to social protection? After a brief introduction and conceptual clarification, each section of the article will focus on one social policy field (employment, pensions, health care) and discuss the origins and consequences of the reforms with respect to the freedom of choice of citizens. The main argument is that very limited attention has been paid in the national political discourse and reform design to the freedom of choice for citizens in welfare state policies, since other goals (such as cost containment) were much more crucial. The article will end with an overall assessment of the evolution of freedom of choice in the Italian welfare state setting.  相似文献

Abstract The European Union's policy of economic concentration and de regulation en tails a creeping loss of sovereignty over social policy for the member States, which are also subject to the common monetary policy: the budgetary discipline they are expected to maintain calls for a constant reduction in social expenditure and the radical privatization of public areas of the economy. The question is whether, by harmonizing its various national fiscal, social and economic policies to a greater or lesser extent, the European Un ion can regain the freedom of action which individual States have lost. Given increasing in terregional competition, member States find them selves also competing in respect of their social systems. The idea of a European social union, dismissed in the past as a pipe dream, is increasingly be coming a necessity for the success of the integration process in the future. The European Union will remain an alien concept for its citizens until it succeeds in developing a specific base for emancipatory democracy. This will only be possible when social justice and a high level of social security benefits are guaranteed for all citizens. The European constitution is an other step in this direction but is not enough by it self; it can only set democratic processes in motion. The creation of a genuine social un ion calls for further initiatives from social security actors, among others.  相似文献

Academics, politicians, and citizens around the world are calling for multidimensional measures of national well‐being to be included in public policy‐making. Under the motto “The Future of Well‐Being,” the 6th OECD World Forum recently pushed forward this debate in Incheon, Korea. Comparing multidimensional well‐being measures across countries, Korea ranks well in income and health, but shows deficiencies in social support, perceived freedom over life choices, air quality, and work‐life balance. Multidimensional measures of well‐being are increasingly being adopted by policy‐makers around the world to improve people's lives.  相似文献
